  1. A CDL holder who operates a CMV is convicted of a nonparking traffic violation committed in a personal car. What does the current federal employer-notification rule require?

Correct answer: Written notice to the current employer within 30 days after conviction.

The rule covers qualifying traffic convictions in any type of motor vehicle, not just a CMV. The thirty-day period starts with conviction, and the notice must be written with the required details. A parking violation is excluded.

  2. A commercial-driver employee receives notice that the driving license has been suspended. What is the federal deadline for telling the current employer?

Correct answer: Before the end of the business day following receipt of the notice.

Loss of driving privileges has a shorter notification deadline than an ordinary traffic conviction. Inform the employer by the end of the next business day after receiving the notice; this does not authorize driving during the suspension.

  3. A driver required to hold a CDL is currently disqualified. A dispatcher asks the driver to take a covered CMV on a short public-road trip. What must the driver do?

Correct answer: Decline to drive the CMV while disqualified.

A disqualified person required to have a CLP or CDL must not drive a CMV. The employer also may not knowingly authorize it. A short distance, an empty vehicle or a supervisor's instruction does not remove the disqualification.

  4. A CDL-required truck driver receives a first conviction for operating a CMV with an alcohol concentration of 0.04. No hazardous material within the CDL definition was being transported. What disqualification does Table 1 specify?

Correct answer: One year from operating a CMV.

The table's CMV alcohol-concentration threshold is 0.04 or greater, and this first nonhazardous-material CMV case carries a one-year disqualification. This is not permission to drive after drinking below that threshold.

  5. A CDL-required CMV driver has a second conviction, from a separate incident within three years, for driving 15 mph above the posted limit. What serious-traffic-violation disqualification does Table 2 specify?

    Correct answer: 60 days.

Speeding at least 15 mph above the limit is a listed serious violation. A second qualifying conviction from a separate incident within three years triggers sixty days; the third-or-subsequent column is different.

Source: 383.51(c), Table 2 row (1), second-CMV-conviction column. eCFR displayed through September 18, 2026; reviewed September 22, 2026. Selected federal responsibilities, not a complete Arkansas intrastate, eligibility or reinstatement guide. ↗

  6. A CDL-required CMV driver has separate qualifying convictions for excessive speeding, improper lane changing and following too closely, all within three years. What period applies to the third conviction under Table 2?

    Correct answer: 120 days.

The table counts combinations of listed serious traffic violations from separate incidents. A third or subsequent qualifying CMV conviction within three years brings 120 days; the offenses do not have to be identical.

Source: 383.51(c), Table 2 rows (1)–(4), third-CMV-conviction column. eCFR displayed through September 18, 2026; reviewed September 22, 2026. Selected federal responsibilities, not a complete Arkansas intrastate, eligibility or reinstatement guide. ↗

  7. A CDL holder has two qualifying serious-traffic convictions in separate personal-car incidents within three years. For the second non-CMV conviction, what additional condition does Table 2 attach to the 60-day CMV disqualification?

Correct answer: The conviction must also revoke, cancel or suspend the holder's driving privileges.

The non-CMV column expressly includes this loss-of-driving-privileges condition. Do not apply the CMV column to every private-car serious-traffic conviction without checking the additional condition.

  8. A driver cited for not having a CDL in possession actually held a valid CDL on the citation date. What does Table 2's footnote require to avoid being guilty of that particular offense?

Correct answer: Give the issuing enforcement authority proof of the valid CDL by the required court-appearance or fine-payment date.

The footnote concerns a credential that was already valid on the citation date and timely proof to the issuing authority. It does not excuse operating before obtaining the proper class or endorsements, or while disqualified.

  9. Before assigning a new driver subject to Part 382 testing to safety-sensitive work, which Clearinghouse query is required?

Correct answer: A full pre-employment query with the driver's specific consent.

The pre-employment requirement is a full query, not the limited-query alternative available for an annual check. The driver must give specific consent, and the employer must address any disqualifying result before covered work.

Source: 382.701(a)(1)–(2). eCFR displayed through September 18, 2026; reviewed September 22, 2026. Selected federal responsibilities, not a complete Arkansas intrastate, eligibility or reinstatement guide. ↗

  10. A covered driver's Clearinghouse record shows the required SAP evaluation and education/treatment process completed and a negative return-to-duty test. Some prescribed follow-up tests remain. What must the employer assume under the stated return-to-duty exception?

Correct answer: Responsibility for managing the remaining prescribed follow-up testing.

Section 382.701(d)(2) allows the stated exception before every follow-up test has occurred if the employer manages the remaining plan. A negative test alone, without the required SAP process, does not satisfy these conditions.

  11. A covered interstate CMV is stopped at a red light. The driver wants to hold a mobile phone for a routine call. Is the stop outside the federal phone rule's definition of driving?

Correct answer: No. A temporary traffic-control stop still counts as driving.

The federal phone rule includes temporary stops caused by traffic, signals and other momentary delays. A red light is not the same as pulling out of traffic to a place where the vehicle can safely remain stopped.

  12. A covered interstate driver moves the truck off the highway and halts where it can safely remain stationary. How does the federal hand-held-phone rule treat that situation?

Correct answer: It is outside that rule's definition of driving.

The exclusion requires moving to the side of, or off, the highway and stopping in a safe stationary location. It does not make an unsafe roadside stop acceptable or cancel other applicable laws.

Source: 392.82(b). eCFR displayed through September 18, 2026; reviewed September 22, 2026. Selected federal responsibilities, not a complete Arkansas intrastate, eligibility or reinstatement guide. ↗

  13. A covered interstate driver drank alcohol three hours ago and plans to go on duty now. Does waiting three hours satisfy the federal pre-duty alcohol interval?

Correct answer: No. Alcohol use is prohibited within four hours before going on duty.

The four-hour rule applies before going on duty as well as before operating or taking physical control of a CMV. Waiting four hours is not a guarantee of fitness; other alcohol and impairment prohibitions still apply.

Source: 392.5(a)(1)–(2). eCFR displayed through September 18, 2026; reviewed September 22, 2026. Selected federal responsibilities, not a complete Arkansas intrastate, eligibility or reinstatement guide. ↗

  14. A covered interstate driver has a measured alcohol concentration of 0.02 while on duty. Does being below 0.04 make that condition permissible under section 392.5?

Correct answer: No. The on-duty rule prohibits any measured alcohol concentration.

The operating and on-duty prohibition is separate from the 0.04 major-offense disqualification threshold. Being below that threshold is not permission to perform covered duty with measured alcohol present.

Source: 392.5(a)(2). eCFR displayed through September 18, 2026; reviewed September 22, 2026. Selected federal responsibilities, not a complete Arkansas intrastate, eligibility or reinstatement guide. ↗

  15. An officer issues a section 392.5 alcohol out-of-service order to a covered driver. When does the stated 24-hour period begin?

Correct answer: When the out-of-service order is issued.

The rule starts the 24-hour period on issuance of the order. The driver must comply with the order; counting backward from a drink or delaying an employer report does not change its start.

Source: 392.5(c)(1)–(2). eCFR displayed through September 18, 2026; reviewed September 22, 2026. Selected federal responsibilities, not a complete Arkansas intrastate, eligibility or reinstatement guide. ↗

  16. A covered truck carries sealed wine that is manifested and transported as part of its shipment. Does the driver's alcohol-possession prohibition in section 392.5 automatically forbid that cargo?

Correct answer: No. Manifested shipment cargo is an express possession exception.

The exception concerns possession of the wine as manifested freight. It does not authorize driver consumption, impairment or violation of any other shipping or licensing requirement.

  17. An employer knows that a driver's CDL prohibits manual-transmission CMVs, but assigns a manual truck anyway. Does the driver's otherwise valid CDL make the assignment acceptable?

Correct answer: No. The employer must not assign operation that violates the CDL restriction.

A current CDL is not enough if the assignment violates its class, endorsement or restriction limits. The employer's responsibility includes circumstances it knows or should reasonably know.

  18. A motor carrier's operation is under an out-of-service order. Its driver and truck are otherwise qualified and serviceable. May the employer authorize a covered CMV trip during that order?

Correct answer: No. An order against the carrier operation also prevents authorization.

The employer rule covers out-of-service orders against the driver, vehicle or motor carrier operation. An otherwise sound truck and qualified driver do not cancel an applicable carrier order.

  19. A driver subject to Part 382 refuses the consent required for an employer’s Clearinghouse query. May the employer continue assigning safety-sensitive work?

Correct answer: No; required consent cannot be refused while continuing those assignments.

The rule bars the employer from permitting safety-sensitive functions when the driver refuses the required consent. A driver’s assurance or a separate license-record check does not replace that consent.

Source: 382.703(c). eCFR displayed through September 18, 2026; reviewed September 22, 2026. Selected federal responsibilities, not a complete Arkansas intrastate, eligibility or reinstatement guide. ↗

  20. A covered employer completed a driver’s pre-employment Clearinghouse query. Which continuing query requirement still applies?

Correct answer: At least one Clearinghouse query each year for the covered employee.

The pre-employment check does not cancel the annual requirement. A consented limited query may satisfy the annual check, but information found through it triggers the separate full-query requirement.

Source: 382.701(b)(1)–(2). eCFR displayed through September 18, 2026; reviewed September 22, 2026. Selected federal responsibilities, not a complete Arkansas intrastate, eligibility or reinstatement guide. ↗
