  1. A New Mexico resident has turned 15 and is enrolled in and attending a state-approved driver-education program. Must the resident finish the program before applying for the ordinary car instruction permit?

Correct answer: No. Proof of enrollment can satisfy this education condition, although the other permit requirements still apply.

At the instruction-permit stage, MVD accepts proof of enrollment or completion in a state-approved program from applicants at least 15. That is not automatic issuance; the remaining application and testing requirements still apply.

  2. Which supervisor meets the published requirements while a New Mexico instruction-permit holder practices driving a car?

Correct answer: A licensed driver age 21 or older, licensed for at least three years, seated beside the learner.

For car practice, the accompanying licensed driver must be at least 21, have at least three years of licensing in New Mexico or another state, and sit beside the learner. The motorcycle seating exception is not a car exception.

  3. A New Mexico learner has not been granted the documented low-nighttime-vision exemption. What practice-driving minimum is required for the provisional-license stage?

Correct answer: 50 hours in total, including at least 10 at night.

The ordinary minimum is 50 actual driving hours, including 10 at night, with parent or guardian certification. The published section separately allows a documented low-nighttime-vision exemption; that exception is excluded from this scenario.

Source: New Mexico MVD, Driver Procedures Manual, Chapter 13: Quick Prints, Section E: Instructional Permits and Provisional Licenses, revised December 8, 2017; Provisional licenses (§66-5-8), practice and certification; reader lines 210–214. Actual agency HTML read October 1, 2026; reader lines are not PDF pages. Selected published agency guidance, not a complete current-statute or handbook review. ↗

  4. A New Mexico learner is convicted of one traffic violation committed while driving with the instruction permit. What happens to the six-month minimum permit period before provisional licensing?

Correct answer: It is extended by 30 days for that violation.

MVD states that each qualifying conviction or delinquency adjudication adds 30 days to the six-month minimum. Finishing that extended period does not waive the other provisional-license requirements.

  5. A New Mexico learner is 15½ and has held the instruction permit for the required period, but is still enrolled in driver education and has not completed it. Do age and permit duration alone qualify the learner for a provisional license?

Correct answer: No. The approved education program and the other Stage 1 requirements must also be completed.

The provisional stage starts no earlier than 15½ and requires successful completion of Stage 1, not merely reaching that age. Required education, practice and testing still apply, along with the published 90-day conviction-free condition.

  6. A New Mexico provisional license holder is driving without a licensed driver age 21 or older in the vehicle. Two 19-year-old friends, neither an immediate family member, want a ride. What does the young-passenger limit allow?

Correct answer: No more than one of those friends in the vehicle.

Without a licensed driver age 21 or older in the vehicle, the limit is one passenger under 21 who is not immediate family. Immediate-family passengers and the adult-accompaniment condition must not be omitted from the rule.

  7. At 1 a.m., a New Mexico provisional license holder wants to drive alone to visit a friend. No school, work, religious, family-necessity or medical exception applies. Is this trip allowed?

Correct answer: No. This unaccompanied social trip is within the midnight-to-5 a.m. restriction.

The ordinary window is 5 a.m. to midnight. Exceptions cover a licensed 21+ companion; documented family necessity, medical necessity, work, school or religious travel; and a medical emergency. A medical emergency is separately listed, not conditioned here on obtaining a signed statement first. None applies to this trip.

Source: New Mexico MVD, Driver Procedures Manual, Chapter 13: Quick Prints, Section E: Instructional Permits and Provisional Licenses, revised December 8, 2017; Provisional licenses (§66-5-8), operating hours and exceptions; reader lines 215–222. Actual agency HTML read October 1, 2026; reader lines are not PDF pages. Selected published agency guidance, not a complete current-statute or handbook review. ↗

  8. A New Mexico provisional license holder has no daylight-only restriction and must drive home from work at 2 a.m. without an adult companion. What evidence supports the specific work exception?

Correct answer: A signed statement from the employer supporting the work travel.

Work travel requires the employer’s signed statement. Separate exceptions cover a licensed 21+ companion, signed evidence for family or medical necessity and school or religious travel, and a medical emergency. The emergency exception is not stated as requiring a letter; this question concerns work only.

Source: New Mexico MVD, Driver Procedures Manual, Chapter 13: Quick Prints, Section E: Instructional Permits and Provisional Licenses, revised December 8, 2017; Provisional licenses (§66-5-8), exceptions to operating-hour restriction; reader lines 215–222, especially 220. Actual agency HTML read October 1, 2026; reader lines are not PDF pages. Selected published agency guidance, not a complete current-statute or handbook review. ↗

  9. A New Mexico provisional license holder is convicted of two traffic violations committed while driving with that license. How do those violations affect the 12-month minimum before a regular license?

Correct answer: They add 60 days to that minimum period.

The 12-month provisional minimum is extended by 30 days for each qualifying conviction or delinquency adjudication. Two such violations add 60 days; all other full-license eligibility conditions still apply.

Source: New Mexico MVD, Apply for a Learner’s Permit; Opening June 17, 2011 amendment notice and Stage 2 minimum; reader lines 237–241 and 282. Actual agency HTML read October 1, 2026; reader lines are not PDF pages. Selected published agency guidance, not a complete current-statute or handbook review. ↗

  10. A New Mexico teen has completed the required provisional period and has no traffic conviction in the preceding 90 days, but a traffic violation and an alcohol-related offense from the provisional period are still pending. Are the published full-license conditions satisfied?

Correct answer: No. Pending traffic violations and pending alcohol- or drug-related offenses during the provisional period are barriers.

The full-license step requires successful Stage 2 completion, no traffic conviction in the preceding 90 days and no pending traffic violation. The teen must also have no guilty finding or pending alcohol- or drug-related offense during the provisional period. A clean recent conviction record alone is not enough.
