  1. 1. A CDL holder who operates a CMV is convicted of a nonparking traffic violation committed in a personal car. What does the current federal employer-notification rule require?
  2. 2. A commercial-driver employee receives notice that the driving license has been suspended. What is the federal deadline for telling the current employer?
  3. 3. A driver required to hold a CDL is currently disqualified. A dispatcher asks the driver to take a covered CMV on a short public-road trip. What must the driver do?
  4. 4. A CDL-required truck driver receives a first conviction for operating a CMV with an alcohol concentration of 0.04. No hazardous material within the CDL definition was being transported. What disqualification does Table 1 specify?
  5. 5. A CDL-required CMV driver has a second conviction, from a separate incident within three years, for driving 15 mph above the posted limit. What serious-traffic-violation disqualification does Table 2 specify?
  6. 6. A CDL-required CMV driver has separate qualifying convictions for excessive speeding, improper lane changing and following too closely, all within three years. What period applies to the third conviction under Table 2?
  7. 7. A CDL holder has two qualifying serious-traffic convictions in separate personal-car incidents within three years. For the second non-CMV conviction, what additional condition does Table 2 attach to the 60-day CMV disqualification?

  11. 11. A Louisiana CDL holder is disqualified from commercial driving but needs truck-driving income. Can an economic hardship license authorize CMV driving during that disqualification?
  12. 12. A Louisiana driver remains disqualified from CMVs, but the related suspension has ended and Class D/E privileges are otherwise valid. What is required before the stated Class D/E license can be issued?
  13. 13. A CMV is temporarily stopped at a red light on a Louisiana highway. Is that pause outside the definition of driving used for the handheld-phone serious-violation rule?
  14. 14. A driver moves a CMV off the highway and halts where it can safely remain stationary. How does Louisiana treat that situation under the stated handheld-phone definition of driving?
  15. 15. An isolated vehicle-weight violation occurs in Louisiana. Is it included in the listed definition of a serious traffic violation for this CDL provision?

  19. 19. A driver subject to Part 382 refuses the consent required for an employer’s Clearinghouse query. May the employer continue assigning safety-sensitive work?
  20. 20. A covered employer completed a driver’s pre-employment Clearinghouse query. Which continuing query requirement still applies?
Review all 20 questions with answers
  1. A CDL holder who operates a CMV is convicted of a nonparking traffic violation committed in a personal car. What does the current federal employer-notification rule require?

Correct answer: Written notice to the current employer within 30 days after conviction.

The rule covers qualifying traffic convictions in any type of motor vehicle, not just a CMV. The thirty-day period starts with conviction, and the notice must be written with the required details. A parking violation is excluded.

  2. A commercial-driver employee receives notice that the driving license has been suspended. What is the federal deadline for telling the current employer?

Correct answer: Before the end of the business day following receipt of the notice.

Loss of driving privileges has a shorter notification deadline than an ordinary traffic conviction. Inform the employer by the end of the next business day after receiving the notice; this does not authorize driving during the suspension.

Source: 383.33. Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  3. A driver required to hold a CDL is currently disqualified. A dispatcher asks the driver to take a covered CMV on a short public-road trip. What must the driver do?

Correct answer: Decline to drive the CMV while disqualified.

A disqualified person required to have a CLP or CDL must not drive a CMV. The employer also may not knowingly authorize it. A short distance, an empty vehicle or a supervisor's instruction does not remove the disqualification.

Source: 383.51(a)(1)–(2). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  4. A CDL-required truck driver receives a first conviction for operating a CMV with an alcohol concentration of 0.04. No hazardous material within the CDL definition was being transported. What disqualification does Table 1 specify?

Correct answer: One year from operating a CMV.

The table's CMV alcohol-concentration threshold is 0.04 or greater, and this first nonhazardous-material CMV case carries a one-year disqualification. This is not permission to drive after drinking below that threshold.

Source: 383.51(b), Table 1 row (3), first-CMV column. Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  5. A CDL-required CMV driver has a second conviction, from a separate incident within three years, for driving 15 mph above the posted limit. What serious-traffic-violation disqualification does Table 2 specify?

    Correct answer: 60 days.

Speeding at least 15 mph above the limit is a listed serious violation. A second qualifying conviction from a separate incident within three years triggers sixty days; the third-or-subsequent column is different.

Source: 383.51(c), Table 2 row (1), second-CMV-conviction column. Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  6. A CDL-required CMV driver has separate qualifying convictions for excessive speeding, improper lane changing and following too closely, all within three years. What period applies to the third conviction under Table 2?

    Correct answer: 120 days.

The table counts combinations of listed serious traffic violations from separate incidents. A third or subsequent qualifying CMV conviction within three years brings 120 days; the offenses do not have to be identical.

Source: 383.51(c), Table 2 rows (1)–(4), third-CMV-conviction column. Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  7. A CDL holder has two qualifying serious-traffic convictions in separate personal-car incidents within three years. For the second non-CMV conviction, what additional condition does Table 2 attach to the 60-day CMV disqualification?

Correct answer: The conviction must also revoke, cancel or suspend the holder's driving privileges.

The non-CMV column expressly includes this loss-of-driving-privileges condition. Do not apply the CMV column to every private-car serious-traffic conviction without checking the additional condition.

Source: 383.51(c), Table 2 second non-CMV column. Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  8. A driver cited for not having a CDL in possession actually held a valid CDL on the citation date. What does Table 2's footnote require to avoid being guilty of that particular offense?

Correct answer: Give the issuing enforcement authority proof of the valid CDL by the required court-appearance or fine-payment date.

The footnote concerns a credential that was already valid on the citation date and timely proof to the issuing authority. It does not excuse operating before obtaining the proper class or endorsements, or while disqualified.

Source: 383.51(c), Table 2 row (7), footnote 1. Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  9. Before assigning a new driver subject to Part 382 testing to safety-sensitive work, which Clearinghouse query is required?

Correct answer: A full pre-employment query with the driver's specific consent.

The pre-employment requirement is a full query, not the limited-query alternative available for an annual check. The driver must give specific consent, and the employer must address any disqualifying result before covered work.

Source: 382.701(a)(1)–(2). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  10. A covered driver's Clearinghouse record shows the required SAP evaluation and education/treatment process completed and a negative return-to-duty test. Some prescribed follow-up tests remain. What must the employer assume under the stated return-to-duty exception?

Correct answer: Responsibility for managing the remaining prescribed follow-up testing.

Section 382.701(d)(2) allows the stated exception before every follow-up test has occurred if the employer manages the remaining plan. A negative test alone, without the required SAP process, does not satisfy these conditions.

Source: 382.701(d)(2). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  11. A Louisiana CDL holder is disqualified from commercial driving but needs truck-driving income. Can an economic hardship license authorize CMV driving during that disqualification?

Correct answer: No; an economic hardship license cannot authorize CMV driving.

Louisiana expressly bars an economic hardship license for commercial driving. Financial need does not restore the commercial privilege; possible noncommercial privileges are a separate matter.

Source: R.S. 32:414.2(A)(1)(b)(i). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  12. A Louisiana driver remains disqualified from CMVs, but the related suspension has ended and Class D/E privileges are otherwise valid. What is required before the stated Class D/E license can be issued?

Correct answer: Surrender the commercial license to OMV.

The statute permits the stated noncommercial license when its conditions are met, but requires surrender of the CDL before issuance. This does not restore commercial driving privileges.

Source: R.S. 32:414.2(A)(1)(b)(ii). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  13. A CMV is temporarily stopped at a red light on a Louisiana highway. Is that pause outside the definition of driving used for the handheld-phone serious-violation rule?

Correct answer: No; a temporary traffic-control stop is included in driving.

For this rule, driving includes momentary delays caused by traffic or a traffic-control device. A red light is not the same as leaving the travel stream and stopping where the vehicle can safely remain stationary.

Source: R.S. 32:414.2(A)(1)(d)(xi). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  14. A driver moves a CMV off the highway and halts where it can safely remain stationary. How does Louisiana treat that situation under the stated handheld-phone definition of driving?

Correct answer: It is excluded from that definition of driving.

The exclusion requires leaving the traffic stream and a location where the vehicle can safely stay stopped. It does not authorize stopping in an unsafe place or override other restrictions.

Source: R.S. 32:414.2(A)(1)(d)(xi), safely stationary exception. Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  15. An isolated vehicle-weight violation occurs in Louisiana. Is it included in the listed definition of a serious traffic violation for this CDL provision?

Correct answer: No; vehicle-weight and defect violations are excluded from that definition.

Exclusion from this particular category does not make an overweight or defective vehicle lawful or safe. Other enforcement, repair and out-of-service consequences may still apply.

Source: R.S. 32:414.2(A)(1)(d)(v), final sentence. Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  16. A Louisiana CMV operator has a measured alcohol concentration of 0.02, below 0.04. May the driver rely on that number to avoid the statute’s alcohol out-of-service rule?

Correct answer: No; measured alcohol can trigger a minimum 24-hour out-of-service period.

Louisiana prohibits measured alcohol during the stated CMV operation and provides a minimum 24-hour out-of-service period for violating that subsection. The 0.04 major-offense threshold is not a permission to drive after drinking.

Source: R.S. 32:414.2(B)(1)(a), (c). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  17. A Louisiana CDL holder subject to the statutory suspected-fraud retest fails the required test. Does the existing card alone allow continued commercial driving?

Correct answer: No; the statute requires indefinite disqualification and a new-applicant process.

The stated retest provision calls for indefinite disqualification after failure or failure to retake the test. Once disqualified, the holder must apply as a new applicant; there is no automatic seven-day restoration.

Source: R.S. 32:414.2(F)(1)(c), (2). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  18. Under Louisiana’s stated CDL credential-replacement provision, OMV requires a holder to surrender credentials for replacement. What consequence is specified if the holder fails to surrender them?

Correct answer: Indefinite disqualification of the holder’s driving privileges.

The provision makes required surrender important to continued privileges. Keeping the old physical credential does not override OMV’s requirement or establish authority to continue commercial operation.

Source: R.S. 32:414.2(F)(3). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  19. A driver subject to Part 382 refuses the consent required for an employer’s Clearinghouse query. May the employer continue assigning safety-sensitive work?

Correct answer: No; required consent cannot be refused while continuing those assignments.

The rule bars the employer from permitting safety-sensitive functions when the driver refuses the required consent. A driver’s assurance or a separate license-record check does not replace that consent.

Source: 382.703(c). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

  20. A covered employer completed a driver’s pre-employment Clearinghouse query. Which continuing query requirement still applies?

Correct answer: At least one Clearinghouse query each year for the covered employee.

The pre-employment check does not cancel the annual requirement. A consented limited query may satisfy the annual check, but information found through it triggers the separate full-query requirement.

Source: 382.701(b)(1)–(2). Read and reviewed September 22, 2026. Selected responsibilities, not an individual eligibility or reinstatement decision. ↗

Louisiana CDL driver responsibilities and disqualification

40 original learning questions in two 20-question tests, with explanations, source references and saved mistakes.

Selected practice, not a complete Louisiana CDL course or an official exam.

Topics and coverage

580 questions cover 60 federal commercial-vehicle questions, 40 air brakes, 40 combination vehicles, 40 passenger transport, 20 tank vehicles, 20 doubles/triples, 60 school-bus, 80 hazardous-materials, 40 road-conditions, 40 hours-of-service, 20 cargo-operations, 40 licensing, 40 inspection/practical-preparation and 40 driver-responsibility scenarios. The licensing questions cover selected requirements; further intrastate exceptions, remaining endorsement material and complete skills coverage are still needed; this is not a complete CDL course.

Sources and coverage

Study written conviction notices, lost-privilege deadlines, major and serious violations, rail crossings, out-of-service orders, Louisiana hardship and downgrade conditions, school-bus endorsement consequences, official retest notices and Clearinghouse responsibilities. Sources checked September 22, 2026.

Consequences depend on the offense, vehicle, previous incidents, time window and applicable provision. Federal table questions identify those conditions; Louisiana-specific questions cite R.S. 32:414.2 or R.S. 32:427. A quiz result, physical license card or expired waiting period is not an individual eligibility or reinstatement decision.

Source comparison: the OMV disqualification summary describes an 18-passenger out-of-service category. Current 49 CFR 383.51 Table 4 uses 16 or more people including the driver, while R.S. 32:414.2(B)(2)(b) says more than fifteen persons. Our 16-person question follows the federal table. Louisiana's statutory school-bus rule also includes a conditional application for reinstatement; five years alone does not guarantee approval.

These original shared and Louisiana-specific scenarios are not extracted competitor or official exam questions. This is not a complete Louisiana CDL course or individual legal advice. Twenty questions is our learning format, not a verified official Louisiana exam length or pass target. The two tests partition the same 40 records; random attempts and mistake review reuse them. Full licensing, appeal and reinstatement procedures still require current official guidance.
